This Waiver, Release and Indemnity Agreement is applicable to all passengers and users of the equipment and services provided by Reel Em In 242 (For the purposes of this Waiver, Release and Indemnity Agreement, the term Reel Em In 242 shall include the captain, crew member(s), owners, managers, officers, directors, volunteers, employees, agents, representatives, servants, assigns, successors, insurers and subsidiaries (where applicable) Reel Em In 242

If any other written or verbal agreement is used in addition to, or in conjunction with, this Waiver, Release and Indemnity Agreement, the provisions of this Agreement shall prevail over any other clauses and/or arrangements in the written or verbal agreement that are inconsistent with this Agreement.

I hereby agree and acknowledge that I am fully aware of the inherent hazards and risks associated with Boat Travel, Boating activity and/or excursions that include but are not limited to drowning, motion sickness, vessel running aground and/or striking or being struck by objects in the water, being injured by close proximity to and/or while handling sea life or animals, being cut or struck by a boat while on board or in the water, injuries occurring while getting on or off a boat, slipping or falling while on board, fishing related injuries, including but not limited to, getting hooked by a hook, gaff or lure, or other perils at sea. I fully understand that these risks can lead to severe injury and even loss of life.

Despite the potential hazards and dangers associated with the activity of Boat Travel and/or Excursions, I wish to proceed and I freely accept and expressly assume all risk, dangers and hazards that may arise from these activities which could result in personal injury, loss of life and property damage to me.

I understand that Boating activity and/or Excursions is not recommended for pregnant women, the elderly, individuals with chronic back or neck problems or previous back or neck injury or those with heart conditions.

I further understand that Boating activity and/or Excursions may be conducted at a site that is remote from competent medical assistance, nevertheless, I choose to proceed even in the absence of competent medical assistance.
I warrant that I am in good mental and physical fitness for Boating activity and/or Excursions and that I am not under the influence of alcohol, nor am I under the influence of drugs. If I am taking medication, I warrant that I have seen a physician and have prior approval to participate in Boating activity and/or Excursions while taking these medications.

By signing this Waiver, Release and Indemnity Agreement, I represent, warrant and covenant that I am fully aware of and expressly assume these and all other risks involved and I agree that I am voluntarily participating in all activities and services provided by Reel Em In 242. and I assume all risk of injury, illness, damage or loss that might result, even if the risks arise out of the negligence or fault of Reel Em In 242

By the execution of this Agreement, I understand and agree that Reel Em In 242 shall not be liable or responsible in any way for any acts or omissions on this trip which may result in property damage, personal injuries, wrongful death or any other damage which I or any minor child under my custody, care, and control, may sustain, as a result of the participation in the activities and services provided Reel Em In 242

I assume full responsibility for any and all such injuries or damages which may occur, and further agree that shall not be liable for any loss or theft of Reel Em In 242 personal property. I specifically agree that Reel Em In 242 shall not be responsible for such injuries, damages, loss or theft, EVEN IN THE EVENT OF NEGLIGENCE OR FAULT BY Reel Em In 242, whether such negligence is present at the signing of this Agreement or takes place in the future.

I hereby agree that I will indemnify and hold harmless Reel Em In 242 for all personal injuries, property damage, or any other damage to any and all third parties, as a result my negligence or misuse of any and all of the services and equipment provided by Reel Em In 242 or my failure to follow the instructions of the Captain or crew member(s) of Reel Em In 242.

I hereby state that I am 18 years or older and legally competent to sign this Agreement.

I hereby acknowledge that I am able to read the English Language well and fully understand the legal consequences of signing this Agreement. I understand and agree that this document is a legal contract which is legally binding upon me.

I hereby state that I have had sufficient time to carefully read the foregoing Agreement and to ask any questions associated with said Agreement. I know the contents thereof, and have signed this Agreement of my own free will and act and without coercion or duress.

I warrant that I am fully aware that I am waiving any right that I may have to bring a legal action or assert a legal claim against Reel Em In 242 for Reel Em In 242. negligence whether by an act or omission.

I, the undersigned parent or guardian of the minor child, hereby warrant that I have the legal right and authority to act on the minor child’s behalf, and I hereby give my consent for the minor child’s participation in this Boating activity and/or Excursion. I further agree to accept responsibility on behalf of the minor child for each and every term and condition of this Agreement set forth above.

I, the undersigned parent or guardian of the minor child further agree to save and hold harmless and indemnify Reel Em In 242 from all liability, loss, cost, claim or damage whatsoever which may be imposed upon Reel Em In 242 because of any defect in or lack of such capacity to so act and I agree to release Reel Em In 242 from any claims brought on behalf of the minor child or by his or her parents or legal guardians.

I also agree to be responsible for any and all damages caused to any of the fishing gear and related equipment and damages to the boat itself due to the minor child’s negligence or misuse or by his or her failure to follow the instructions of the Captain or crew, and I agree to pay for all costs necessary to repair or replace any and all such damage or loss of use of said fishing gear or related equipment or the damages to the boat caused by my minor child’s act or omission

All payments are in BSD

There is a 20% cancelation fee. Cancellation must be two (2) weeks or more prior to reserved date.

Refunds will be issued if you cancel two (2) weeks or more prior to your trip. However there is a 20% cancelation fee. Contact us via email or at 242-424-7577 if you need to cancel.
